Welcome to Kettieklub. These Terms and Conditions ("Terms") govern your use of the Kettieklub platform and services. By accessing or using our platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, registering as a member, or using any part of the Kettieklub platform, you:

• Acknowledge that you have read and understood these Terms
• Agree to be bound by these Terms and our Privacy Policy
• Represent that you are at least 10 years of age
• Confirm that all information provided is accurate and truthful

2. Service Description

Kettieklub is a multi-club platform for managing:

• Member registrations and profiles
• Club events and competitions
• Score recording and rankings
• Inter-club events and competitions
• Club administration and communication

We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice.

3. User Accounts

3.1 Account Registration

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your password
• You must be at least 10 years of age to register
• Members under 18 require parental/guardian consent (verified by club administrators)
• One person may only create one account per club

3.2 Account Security

• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• We are not liable for losses caused by unauthorized use of your account
• You must not share your login credentials with others

3.3 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Provide false or misleading information
• Remain inactive for extended periods (12+ months)

4. User Conduct and Responsibilities

4.1 Prohibited Activities

You agree NOT to:

• Upload false scores or manipulate rankings
• Impersonate another person or entity
• Harass, threaten, or abuse other users
• Use the platform for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Introduce viruses, malware, or malicious code
• Scrape, copy, or download large portions of data without permission
• Use automated systems (bots) to access the platform
• Interfere with the proper functioning of the platform

4.2 Content Standards

All content you provide (bio, messages, comments) must:

• Be respectful and appropriate
• Not contain offensive, discriminatory, or hateful language
• Not infringe on intellectual property rights
• Comply with South African laws and regulations

5. Score Recording and Rankings

5.1 Score Accuracy

• Club administrators are responsible for accurate score entry
• Scores must reflect actual performance in recognized events
• Falsifying scores may result in account termination
• Disputes about scores must be resolved with your club administrator

5.2 Rankings and Leaderboards

• Rankings are calculated automatically based on recorded scores
• Rankings may be visible to other club members and (for inter-club events) to other clubs
• We do not guarantee the accuracy of rankings but rely on accurate score entry
• Historical rankings may change if scores are corrected or removed

6. Club Administration

6.1 Club Responsibilities

Club administrators must:

• Verify the identity and eligibility of members
• Ensure accurate score recording
• Maintain proper conduct within their club
• Obtain proper consent from members (especially minors)
• Comply with applicable shooting sports regulations

6.2 Club Applications

• Club applications are subject to approval by Kettieklub site administrators
• We reserve the right to reject applications without providing a reason
• Approved clubs receive administrator accounts and platform access
• Clubs may be suspended or removed for violating these Terms

7. Intellectual Property

7.1 Platform Ownership

Kettieklub and all its original content, features, and functionality are owned by Kynetik and are protected by international copyright, trademark, and other intellectual property laws.

7.2 User Content License

By submitting content to the platform, you grant us:

• A non-exclusive, worldwide license to use, display, and distribute your content
• Permission to use your name and scores in rankings and leaderboards
• The right to use aggregated/anonymized data for analytics and improvement

7.3 Trademarks

"Kettieklub" and associated logos are trademarks. You may not use these without prior written permission.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which complies with the Protection of Personal Information Act (POPIA), 2013.

By using our platform, you consent to:

• Collection and processing of your personal information as described in our Privacy Policy
• Display of your name and scores in rankings (within your club and in inter-club events)
• Communication from your club administrators and (with consent) from Kettieklub

9. Disclaimer of Warranties

We specifically disclaim:

• Any warranty that the service will be uninterrupted or error-free
• Any warranty regarding the accuracy or reliability of scores and rankings
• Any warranty that data will never be lost or corrupted
• Any implied warranties of merchantability or fitness for a particular purpose

You use the platform at your own risk.

10. Limitation of Liability

To the maximum extent permitted by South African law, Kettieklub, Kynetik, and its directors, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data, scores, or rankings
• Business interruption or loss of profits
• Damages arising from disputes between members or clubs
• Unauthorized access to your account due to your failure to secure credentials
• Actions or omissions of club administrators

Our total liability for any claim arising from your use of the platform shall not exceed R1,000 (One Thousand Rand) or the amount you paid for services (if any), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kettieklub, Kynetik, and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your use or misuse of the platform
• Content you submit to the platform

12. Third-Party Services

Our platform may contain links to third-party websites or services (such as QR code generators). We are not responsible for:

• The content, accuracy, or practices of third-party sites
• Privacy policies of external services
• Any damages arising from your use of third-party services

Use of third-party services is at your own risk.

13. Dispute Resolution

13.1 Informal Resolution

If you have a dispute, please contact us first at kettieklub@kynetik.co.za. We will attempt to resolve issues informally within 30 days.

13.2 Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

13.3 Arbitration

If informal resolution fails, disputes may be submitted to arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA), unless litigation is legally required.

14. Force Majeure

We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including:

• Natural disasters, pandemics, or acts of God
• War, terrorism, civil unrest, or government actions
• Internet service disruptions or hosting provider failures
• Cyberattacks, hacking, or data breaches despite reasonable security measures

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting with an updated "Last Updated" date. Significant changes will be communicated via email.

Your continued use of the platform after changes constitutes acceptance of the modified Terms. If you do not agree to changes, you must discontinue use and may request account deletion.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kettieklub regarding use of the platform, superseding any prior agreements.
